Alina Habba has left her position as New Jersey's top federal prosecutor. This follows a legal ruling that questioned her eligibility to hold the office.

Acceptance of Resignation

The nation's top law enforcement official, the Attorney General, accepted the prosecutor's departure on Monday. She commented that the court's "flawed" ruling made it "untenable" for the official to effectively run her office.

"Do not interpret adherence to the ruling as defeat," she wrote. "My fight will now extend throughout the country."

The departure follows closely on a US appeals court found that she had been unlawfully serving as the federal prosecutor. This decision is could influence scores of prosecutions in New Jersey.

The appellate judges said that a acting appointment that did not receive Senate approval ran afoul of the statute on vacant positions.

The Attorney General added that she will continue working within the DOJ as a senior adviser. Habba plans to seek further review of the ruling, with hopes of a overturned decision.
