Andrej Babiš, the self-proclaimed tycoon that secured victory in last month's Czech election, has declined to sell his vast corporate assets, while insisting he will resolve a conflict of interest that could block him from taking the position of prime minister.

Stance on Business Holdings

Babiš, whose ANO party came first in the October election but did not secure a majority in parliament, stated in a online statement that he would not sell his Agrofert conglomerate, which is active in farming, food processing, and chemicals.

“I have consistently stated I will not sell Agrofert. I have repeatedly said I will resolve the conflict of interest in accordance with national and EU regulations,” Babiš remarked. “This is different from selling a roll in a bakeshop.”

President's Requirement

The Czech president, Petr Pavel, announced that the 71-year-old political figure must clarify openly how he will remove ethical conflicts arising from his corporate dealings before being appointed prime minister.

The national charter “clearly mandates the president to consider the possible emergence of a conflict of interest and the possibilities for its resolution” when appointing government ministers, Pavel's office noted.

The president “expects clarity in what specific way Andrej Babiš will meet his constitutional and legal obligations”, the announcement said, stating that Pavel was prepared to designate Babiš as prime minister “immediately” once the matter was settled.

Business Operations and Regulatory Concerns

Babiš's several hundred firms, primarily under the Agrofert umbrella, function in the Czech Republic and other central European states, receiving millions of euros in domestic and European farming and other subsidies, as well as government deals.

Under Czech law, cabinet members cannot obtaining public aid or agreements. The ethics watchdog Transparency International has indicated that to prevent a ethical breach, Babiš must either divest, decline public contracts, or not enter public office.

Previous Tenure and Current Intentions

Babiš affirmed he would “follow the laws” if selected as prime minister, but declined to explain how in beforehand because the matter was “an extremely sensitive and private affair for me, and the media will invariably criticise me regardless”.

During his first term as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an European inquiry over possible ethical issues. He placed his assets into fiduciary arrangements, while keeping certain control over them.

A judicial body and the EU executive both determined that this was insufficient. Babiš stated recently that he was again the exclusive proprietor of Agrofert and maintained he was “implementing measures” to prevent a ethical problem, but refused to disclose details.

Governing Deal and Foreign Policy Consequences

The wealthy politician has signed a coalition agreement with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has called for a public vote on exiting the EU, and the Motorists for Themselves, which has mainly opposed the EU’s Green Deal.

The incoming administration, if confirmed, is likely to strengthen the populist movement in the region and might strain backing from Western nations for Ukraine – although Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to assure him of the nation's backing.

Pavel, who as head of state shares responsibility for foreign policy, also demanded that the government agenda add a declaration on the official stance on Russia’s war in Ukraine, with a pledge to fulfilling Nato obligations.

The head of state has previously stated he would not approve any ministerial nominees who might question the Czech Republic’s international alliances, a condition that the ultra-conservative party has said it will meet by proposing independent technocrats.
